Privacy Policy

Written to be read, not to be skimmed past. If anything here is unclear, call us and we will explain it.

The short version

We are a small marketing firm in Tucson. We do not sell your personal information — not for money, not for anything else. We have no user accounts, take no payments on this site, and store no passwords. Our contact forms open your own email program rather than sending data to our server. We use Google Analytics to understand which pages people read. That is essentially all of it; the detail below explains each piece.

1. Who we are

This site, guerrafourcademkt.com, is operated by Guerra Fourcade LLC, doing business as Guerra Fourcade Marketing & Consulting and as GF Marketing and Consulting, located in Tucson, Arizona 85718, United States.

In this policy, "we", "us" and "our" mean Guerra Fourcade LLC. "You" means anyone who visits this website or contacts us through it.

2. What this policy covers

This policy covers this website and the ways you can contact us through it. It does not cover:

Other websites we link to, including LegalShield, social media platforms and the Better Business Bureau. Each has its own policy
Client engagements governed by a signed services agreement, where that agreement controls
Data we process on behalf of a client as part of their own marketing, which belongs to that client

3. Information you give us

This site has two forms — a contact form and a pre-consultation questionnaire. Between them they ask for your name, phone number, email address, company name, area of interest, budget range, timeline and any details you choose to write.

How our forms actually work

This is unusual enough to be worth stating plainly. Our forms do not transmit anything to this website's server. When you press submit, the form assembles what you typed into a draft message and opens it in your own email program. Nothing is sent until you send it, and you can see and edit the whole message first.

The practical consequences: this website stores no form submissions, there is no database of enquiries to breach, and if you change your mind before hitting send in your mail program, we never receive anything at all. Once you do send it, your message reaches our business email inbox and is handled as ordinary business correspondence.

You may also give us information by emailing us, calling us, sending a WhatsApp message, or during a consultation. We keep what is necessary to respond and to do the work.

4. Information collected automatically

Server logs. Our web host records standard technical information for every visit: IP address, browser type and version, operating system, referring page, pages requested, and date and time. This is normal web server behaviour and is used for security, troubleshooting and abuse prevention.

Analytics. We use Google Analytics 4 to understand how the site is used — which pages get read, how people arrive, which links get clicked, roughly what region visitors come from. Google Analytics sets cookies and collects an identifier for your browser. We use it to improve the site, not to identify you personally.

Outbound link tracking. When you click certain external links — notably the LegalShield membership links — we record that a click happened and which link it was. We do not learn anything about what you do on the destination site.

Search Console. We use Google Search Console, which reports aggregate search terms and click data. It does not identify individual visitors.

5. Cookies and similar technologies

Cookies are small files a website stores in your browser. This site uses them only for analytics — we set no advertising cookies and run no advertising pixels or remarketing tags on this site.

You can block or delete cookies through your browser settings at any time. Blocking them will not break this website; nothing here depends on them. Google also publishes a browser add-on that opts you out of Google Analytics entirely, at tools.google.com/dlpage/gaoptout.

Your browser may also load fonts from Google Fonts and one JavaScript library from Cloudflare's CDN. Those providers receive your IP address as a necessary part of delivering the file, in the same way any web server does. Neither is used by us for tracking.

6. Third parties that may receive data

We keep this list short deliberately. As of the effective date above, loading or using this site may involve:

Google — Analytics, Search Console and Fonts
Cloudflare — public CDN serving one JavaScript library
Better Business Bureau — the accreditation seal image loads from their server
Our web hosting provider — stores the server logs described above
Our email provider — receives messages you choose to send us

7. How we use information

To respond to your enquiry, prepare for and hold consultations, deliver services you have engaged us for, send information you asked for, keep ordinary business and accounting records, improve this website, and protect against fraud, abuse and security threats.

We do not use your information to make automated decisions that produce legal or similarly significant effects about you.

8. We do not sell your information

We do not sell personal information. We do not share it for cross-context behavioural advertising. We do not trade, rent or barter contact lists.

We disclose information only to the service providers listed in section 6 who need it to operate the site or our business, to professional advisers such as accountants or lawyers where necessary, where required by law or valid legal process, to protect the rights and safety of any person, or to a successor entity if the business is sold or reorganised.

9. How long we keep it

Enquiries that do not become engagements: generally up to two years, so we can pick up a conversation where it left off. Client records: for the duration of the engagement and afterwards as long as needed for legal, tax and accounting obligations, typically seven years. Server logs: as retained by our host, typically weeks to months. Analytics: per the retention setting in Google Analytics, currently fourteen months.

You can ask us to delete your information sooner. See section 10.

10. Your choices and rights

Wherever you live, you may ask us to tell you what personal information we hold about you, correct it if it is wrong, delete it, or stop using it for marketing. Email info@guerrafourcademkt.com and we will respond within a reasonable period, ordinarily within 45 days. We may need to verify your identity first, and we may need to keep certain records where the law requires it.

If you are a California resident, the CCPA as amended by the CPRA may give you rights to know, delete, correct, opt out of sale or sharing, and limit use of sensitive personal information. We do not sell or share personal information as those terms are defined, and we do not collect sensitive personal information through this site. We will not discriminate against you for exercising any right.

If you are in a state with a comprehensive privacy law — including Colorado, Connecticut, Virginia, Utah, Texas, Oregon and others — you may have comparable rights, including the right to appeal a refused request. To appeal, reply to our decision and say you are appealing; we will review it.

If you are in the European Economic Area or the United Kingdom, you may have rights of access, rectification, erasure, restriction, portability and objection, and the right to lodge a complaint with your supervisory authority. We are based in the United States and this site is aimed at businesses in Arizona, the wider United States and Sonora, Mexico. If you contact us from Europe we will honour these rights as a matter of practice.

11. Do Not Track and Global Privacy Control

There is still no common industry standard for how websites should respond to Do Not Track browser signals, so this site does not respond to them. We do honour the Global Privacy Control signal where it applies — though since we neither sell nor share personal information, it has little practical effect here.

12. Email and text messages

If you give us your email address we may send you information you requested and occasional updates about our services. Every marketing email includes an unsubscribe link, and we act on it promptly, as CAN-SPAM requires.

If you give us your phone number, you may receive calls or text messages from us about your enquiry. Message and data rates may apply. Reply STOP to any text to stop receiving them; reply HELP for assistance. Giving us your number is never a condition of buying anything from us.

13. Children

This is a business-to-business website and it is not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has given us information, contact us and we will delete it.

14. Security

This site is served over HTTPS with modern transport security, publishes a security contact at /.well-known/security.txt, and carries standard browser protection headers. It has no login, no user accounts, no stored passwords and no payment processing, which removes entire categories of risk by design.

We take reasonable measures to protect information in our possession. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Email in particular is not a secure channel — please do not send us social security numbers, financial account numbers, health information or other sensitive data by email or through our forms. If you need to share something sensitive, call us and we will arrange a secure method.

15. Links to other sites

This site links to third-party websites including LegalShield, LinkedIn, Instagram, Facebook, TikTok, YouTube, WhatsApp, Google and the Better Business Bureau. We do not control them and are not responsible for their content or privacy practices. Read their policies before giving them information.

16. Visitors outside the United States

We operate from Tucson, Arizona. If you use this site from another country, your information will be transferred to and processed in the United States, where privacy laws may differ from those where you live. Using this site means you understand that.

17. Changes to this policy

We may update this policy as our practices or the law change. The effective date at the top always reflects the current version. Material changes will be signposted on this page. Continuing to use the site after a change means you accept the updated policy.
